INTRODUCTION In any society relatively few disputes are brought to judges for resolution. Most are handled informally or forgotten. Fewer still are cases that go to trial. Most are settled. Compromises are reached even in cases where issues are hotly contested and where millions or billions of dollars in damages are claimed. Recently, for example, one of the most controversial lawsuits of our time, the Agent Orange case, was settled. In that case, veterans of the Vietnam War, their spouses, and (...) their children alleged that a defoliant — Agent Orange – used in Southeast Asia contained dioxin and was responsible for deaths, debilities, miscarriages, and birth defects suffered by members of the plaintiff class. Class members argued that the manufacturers of the defoliant, seven major chemical companies, knew that it was tainted and should be made to compensate them for their injuries, claiming billions of dollars in damages. The case received national exposure and became a rallying point for veterans, a means they hoped to use to publicize their plight and to spur Congress to come to their aid. On the eve of trial, the case was settled. The defendants, who denied liability throughout the pretrial period, agreed to pay the veterans $180 million. In turn, the plaintiff class agreed to drop the suit. Thus ended a controversy which not only presented novel legal issues and tested the ability of the federal courts to handle complex lawsuits, but concerned the well-being of a large number of veterans, their spouses, and their handicapped children as well. Legal philosophers divide over whether it is possible to analyze legal concepts without engaging in normative argument. The influential analysis of legal rights advanced by Jules Coleman and Jody Kraus some years ago serves as a useful case study to consider this issue because even some legal philosophers who are generally skeptical of the neutrality claims of conceptual analysts have concluded that Coleman and Kraus's analysis manages to maintain such neutrality. But that analysis does depend in subtle but important (...) ways on normative claims. Their argument assumes not only a positivist concept of law, but also that it counts in favor of an analysis of legal rights that it increases the number of options available to legal decisionmakers. Thus, whether Coleman and Kraus's analysis is right in the end depends on whether those normative assumptions are justified. If even their analysis, which makes the thinnest of conceptual claims, depends on normative premises, that fact serves as strong evidence of the difficulty of analyzing legal concepts while remaining agnostic on moral and political questions. In his essay, “Negative and Positive Positivism,” Jules L. Coleman extends in two important ways the Legal Positivism of H. L. A. Hart. First, he shows that the “separability thesis”—the claim that no necessary or constitutive relationship exists between law and morality—to which Positivists are wedded does not entail the view, attributed by Ronald Dworkin to Legal Positivists, that law consists in “hard facts.” Instead, the separability thesis requires only the possibility of deciding the truth of propositions of law. (...) This weaker requirement can be met by rules of recognition that are semantically adequate but that fail to set out tests by means of which the legal status of rules and norms may be verified. Second, Coleman argues that one can subscribe to the separability thesis and still maintain that judges may have a legal duty to couch decisions in moral terms whenever the “content or proper formulation of [a] rule of recognition” is in dispute. Such a legal duty may exist in virtue of a convergent practice “among judges of resolving the controversy in a particular way”. (shrink)

Until recently the most prominent defender of the openness of God was Charles Hartshorne. Evangelical thinkers are now defending similar ideas while being careful to distance themselves from the less orthodox dimensions of process theology. An overlooked figure in the debate is Jules Lequyer. Although process thinkers have praised Lequyer as anticipating their views, he may be closer in spirit to the evangelicals because of the foundational nature of his Catholicism. Lequyer’s passionate defense of freedom conceived as a (...) creative act as well as the theological implications he drew from this are examined for their relevance to the present discussion of the openness of God. Wright's primary achievement was to apply utilitarian principles to Darwinian natural selection theory. Since Darwin himself made no such attempt, nor did John Stuart Mill, and since Darwin showed an evident interest in Wright's attempt, this represents (...) a major contribution to evolutionary theory. On the negative side, too, Wright was incisive in his criticisms of Spencer, Mivart, Hamilton, Mansel, and Lewes. The pragmatic strains in Wright's philosophical method were incidental to his primary interest in showing that sciences are metaphysically "neutral." But his influence on Peirce and James was direct and strong, both on their cosmological and methodological doctrines. The philosophers at the University of Padua during the late Middle Ages and Renaissance arc attracting much renewed interest. This study makes accessible again the logical philosophy of Girolamo Balduino, professor at Padua during the second quarter (...) of the sixteenth century. Like other thinkers of his period, 13alduino follows the logic of Aristotle, and looks for progress within the ancient and mediaeval tradition, not for radically new doctrines. He continues the traditional interpretation of Aristotle by Averroes, for whom logic is only an instrumental habitus, a tool or method of demonstration. About the final contribution of the school of Padua to the improvement of Aristotelian logic was the doctrine of regressive demonstration, where demonstration terminates in or discloses the definition. Zabarella's well-known teaching on this point seems to be derived entirely from Balduino. Contrary to the interpretation of Cassirer, followed by Randall, this regressive demonstration is not a universal method of inquiry and is not at all like, and not the historical source of, the new method of Galileo. Papuli's book is solidly based on the original Latin texts, in notes, which are of great value in view of the fact that Balduino's works have been out of print since 1573. Not all of Papuli's interpretations are beyond criticism (e.g., p. 296), but he has done a service in enabling us to reestablish contact with one of the last significant commentators on Aristotle's logic. Pp. 196+22 facsimile illustrations) Giulio Cesare Vanini (1585-1619) ranks with Giordano Bruno as a modern hero of freedom of philosophical expression. He was tortured and then burned at the stake in Toulouse at the age of thirty-four, because of the unorthodoxy of his views. For this reason, he has drawn more attention than is perhaps deserved on the basis of his rather mediocre writings, which are little more than a tissue of plagiarisms culled from Pomponazzi, Cardano, J. C. Scaliger, and others. In this volume, Emile Namer has collected the scattered documents dealing with Vanini's life and activities. This is a valuable service, for it should enable scholars to disentangle fact from fiction and reality from myth. There has been so much heated discussion regarding Vanini that it is now time that someone should attempt to establish the precise facts and to reevaluate Vanini's place in intellectual history. In the past, writings about him have been governed more often by emotion than by reason. Namer prints documents from Naples, London, Paris, Simancas, and Toulouse. Some of these have been printed before in various journal articles, but it is valuable to have them all together in a single volume. In addition, he prints relevant excerpts concerning--as one of them put it--le douzi~me apostre de Satan, including material from Mersenne, Garasse, and others. He also includes a series of facsimiles of sample pages from the documents which he prints. All in all Namer's work is competently 250 HISTORY OF PHILOSOPHY done, though perhaps a bit more annotation to put the documents in historical perspective would have been desirable. In any case this little volume must be one of the bases for any future serious biographical or interpretative studies dealing with Vanini. Moreover, it shouM also be useful for scholars dealing with more general questions of seventeenth-century intellectual, religious, and social history. Unfortunately, there is no index, nor bibliography of earlier literature on Vanini, and the Introduction is perhaps too brief to orient the reader who has little previous knowledge of Vanini. This article examines the thought of the nineteenth-century French thinker Jules Lequyer, who influenced Charles Renouvier, William James, and Jean-Paul Sartre. Charles Hartshorne, who never ceased to promote Lequyer's importance, refers to the Frenchman in all but five of his twenty-one books. Lequyer is especially noteworthy because of his philosophical defense of human freedom against any sort of determinism.

ABSTRACT This article examines the Fourierist reception of Owenism. In challenging the established historiography on Owen’s reception in France, the article draws on a wide range of Fourierist material – letters, unpublished draft manuscripts, and neglected articles in Fourierist and non-Fourierist periodicals – that previously not accessible to twentieth-century historians in order to reassess the Fourierist response to Owen and Owenism. The article pays special attention to the work of Fourier’s leading disciple, Victor Considerant. It contrasts Fourier’s highly critical evaluation (...) of Owen’s work, with Considerant’s more considered reading of Owen and conciliatory approach in dealing with other socialists, such as the Saint-Simonians and Owen’s French disciples. The article also examines the work of some of Fourier’s other followers, including Jules Lechevalier, Adrien Berbrugger, Alexandre Baudet-Dulary, and Amédée Paget and their evaluations of Owen and Owenism. An influential critique of anger holds that anger comes at an important epistemic cost. In particular, feeling angry typically makes risk less visible to us. This is anger’s ‘red mist.’ These epistemic costs, critics suggest, arguably outweigh the epistemic benefits commonly ascribed to anger. This essay argues that the epistemic critique of anger is importantly misleading. This is not because it underestimates anger’s epistemic benefits, but rather because it overlooks the fact that anger’s red mist performs a crucial moral function. (...) By concealing risk, the red mist helps protect the dignity and self-respect of those who live under severe and unchosen risk. This function is vitally important in non-ideal circumstances, where many are unjustly subjected to dignity-impairing risk. And it is irreplaceable, in that it cannot readily be performed by other political emotions, such as hope. Beyond providing a novel defence of anger, this argument has a broader upshot. Anger’s red mist reveals that ignorance is not always problematic in politics. Accordingly, it should not be treated—as has standardly been the case—as an unmitigated political evil. In the first instance, our efforts are better spent ascertaining when ignorance is a problem, and when, instead, it performs a felicitous function. (shrink)

It refutes commonly held claims that hermeneutic analyses are necessarily relativistic, Eurocentric, or critically impotent and demonstrates how hermeneutic procedures can inform analyses of urgent current and cross-cultural issues such (...) as the biology of race, female genital excision, and the so-called "culture of poverty" thesis. Lorenzo Simpson demonstrates that a robust methodology of philosophical hermeneutics is well positioned to intervene in critical political and social issues in global ethics and justice in concert with critical theory's emancipatory aims. The two figures primarily associated with each side of the debate were Maine de Biran and Charles Renouvier. Biran developed powerful objections to Hume's arguments that purported to prove the impossibility of the experience of one's inner causal force. This book is about the respective roles of intuition and reasoning in ethics. It responds to a number of well-known philosophers and psychologists, and proposes a new perspective – radical in its moderation. It examines in depth the work of the philosopher Joshua Greene and the psychologist Jonathan Haidt. With the so-called empirical turn in ethics, much work has been done to try to isolate the role of reason and intuition in forming our moral judgements, with Haidt and Greene leading (...) the research programmes and attracting much of the professional and public attention, and many others following. The current view – shared by both camps – is that intuition is largely the driver of our moral judgements – a view summed up in Haidt’s slogan ‘intuition first, strategic reasoning second’. Haidt believes we have to live with this and accept it. Greene does not: he contends that our intuitions, while suitable for the environments in which we evolved, are worthless in the modern, global, technological age, and to avoid ethical disaster we must learn to adopt reason as the arbiter of moral truth. This book steers a middle course between these two positions and is therefore of great interest to philosophers and psychologists alike. (shrink)

The method of reflective equilibrium is typically characterized as a process of two kinds of adjustments: hold fixed one’s current set of commitments/intuitions and adjust rules/principles to account for them, then hold fixed those rules while making adjustments to one’s set of commitments. Repeat until no further adjustments are required. Such characterizations ignore the role of precedent, i.e., information about the commitments and rules of others and how those might serve as guides in one’s own process of deliberation. In this (...) paper we develop a model that narrows in on a local part of a reflective equilibrium process in which a group of peer agents start with identical lists of commitments and work towards finding the rule that captures that set. If successful, we say they reach rest stop interpersonal convergence. The trouble is that, without precedent, reaching this convergence rests on implausible deterministic assumptions. The COVID-19 pandemic caused university education to transition from face-to-face contacts to virtual learning environments. Young adults were forced to live an entirely new life online, without valuable and enjoyable social interaction. We examined subjective perspectives towards life online during the pandemic. We identified four viewpoints about life mediated by computers. Two viewpoints express “struggling”: Viewpoint 1 (Angry, Depressed and Overwhelmed), and Viewpoint 3 (Restricted to and Overwhelmed by Virtuality). A third feeling-state conveys experiences of “surviving”: Viewpoint 4 (Isolated and (...) Powerless in Convenience). Surprisingly, Viewpoint 2 is about “thriving” (Comfortable and Convenient Routine with Computers). The research shows that virtualization, confinement, and anxiety are taking a toll on the mental health of some members of the younger generation, while at the same time other members feel they are thriving in a situation of limited resources, virtuality, and reduced face-to-face human interaction. Brummell fut le Prince des Dandys, dit-on. Il fut aussi et surtout un individu grossier, égoïste, agressif, ironique, cynique, malpoli, menteur, escroc, insultant, arrogant, suffisant, prétentieux et, bien sûr, content de lui, vivant de reprocher aux autres leur mauvais goût, leur inélégance, leur fatuité, leur manque d'éducation. Ce personnage réel, recouvert par son mythe et sa légende, fut l'étoile brillante de la société mondaine anglaise pendant une vingtaine d'années, avant d'être, pendant un quart de siècle, sur le sol français, un (...) pitoyable personnage, un raté minable, un pique-assiette mal élevé, un misanthrope syphilitique, un gâteux, puis un demi-fou enfermé à l'asile. De quelle manière cet adulte, qui ne fut jamais qu'un gamin mal élevé, est-il devenu l'incarnation du poète de l'existence? Par la grâce d'un autre dandy, Jules Barbey d'Aurevilly, qui publie Du dandysme ou de George Brummell, et de Charles Baudelaire. Brummell fut un déchet; Barbey en fit un astre noir; Baudelaire, un feu latent qui pouvait rayonner, mais ne voulut pas... Le dandy a-t-il encore des choses à nous dire en ces temps nihilistes? This article offers to outline a direction for a decolonial political theory based on Aimé Césaire’s and Frantz Fanon’s thoughts. In doing so, I will first discuss some work of comparative political theory that could be associated with an attempt to decolonize political theory. Rather than a systematic critique of these works, this article aims to outline some of their limits from a decolonial perspective, such as their embedment in a continental ontology/logic, and their over-emphasis on methodology that can lead (...) to an instrumental account of politics. In contrast, I will argue for a decolonial existential political theory that grounds its investigation in what Frantz Fanon called ‘the zone of nonbeing’ and that takes politics as first philosophy. To make my point, I will discuss Aimé Césaire’s Letter to Maurice Thorez and Frantz Fanon’s Political Theory of the Damnés. (shrink)

This paper examines how indigenous African communities have become critical for developing epistemologies of relation and entanglement in the dominant problem of contemporary resilience understandings of adaptation in the Anthropocene imaginary. Grounded in the indigenous African epistemological philosophies, this paper explores critical alternative futural framings that directly oppose the modernist epistemological understandings of resilience imaginaries in the Anthropocene. The analysis presented here is based on understanding indigenous non-modern ways of knowing as key in the context of ecological crisis in the (...) Anthropocene resilience. This paper argues that reductionist modernist epistemology fails to fully acknowledge how alternative futural imaginaries of indigenous non-modern ways of knowing have become central to critical Anthropocene resilience approaches in the discipline of International Relations. In contrast, this paper explores indigenous African epistemologies of relation and entanglement as alternative futural imaginaries that better capture resilience climate adaptation in the Anthropocene. The paper concludes that focusing on resilience and understandings of adaptation in the Anthropocene opens other possibilities for the development of indigenous non-modern ways of knowing. (shrink)

Distinctive for its pungent and oftentimes rotten odor, the thorny fruit of durian (Durio spp.) is considered a delicacy throughout Asia. Despite its burgeoning global recognition, durian remains a fruit of contradiction—desirable to some yet repulsive to others. Although regarded commonly as immobile, mute, and insentient, plants such as durian communicate within their own bodies, between the same and different species, and between themselves and other life forms. As individuals and collectives, plants develop modes of language—or phytodialects—that are specific to (...) certain contexts. Focused on vegetal semiosis or sign processes, a phytosemiotic lens views plants as dynamic and expressive subjects positioned within lifeworlds. Absent from phytosemiotic theory, however, are the cultural sign processes that take place within and between plants—what I call cultural phytosemiotics. The framework I propose calls attention to the interlinked biological, ecological, and cultural dimensions of signification between plants and non-plants. From a phytosemiotic standpoint, this article examines historical, cinematographic, and literary narratives of durian. Reflecting the fruit’s divisive sensory effects, historical accounts of Durio by Niccolò de’ Conti, Jan Huyghen van Linschoten, Georg Eberhard Rumphius, and William Marsden alternate between praise and disdain. Moreover, films such as Fruit Chan’s Durian Durian (2000) and Anthony Chen’s Wet Season (2019) narrativize the polarities that similarly figure into historical depictions of the species. Literary narratives, including the poems “Durians” (2005) by Hsien Min Toh and “Hurling a Durian” (2013) by Sally Wen Mao, investigate the language of durian’s olfactory and gustatory sensations. Along a continuum between adoration to revulsion, durian embodies the otherness of vegetal being. In an era of rampant biodiversity loss, learning to embrace botanical difference should be a human imperative. (shrink)
